Why did my case get sent to a mediator?

Your case was referred to mediation because one or both parties filed a Petition or a Motion with the Clerk of Court at the referring jurisdiction.

What happens if we don’t come to an agreement?

If you don’t come to an agreement, your case will be returned to the referring court for a hearing before a judge. There is no penalty for trying mediation first. Information and discussion from your mediation session is not shared with the court.

My child received a summons, do they need to come to court?

NO. Children should not be brought to the mediation orientation or to the mediation session.

Do I need an attorney to represent me during the mediation?

No. You do not need an attorney. Most mediations do not include counsel. However, if both parties agree, attorneys may be present during your mediation. You may also have an attorney review your agreement prior to signing.
